O estudo objetiva analisar a importância do jurado no Tribunal do Júri, a partir do conto Suje-se Gordo! de Machado de Assis, destacando a subjetividade nas decisões do júri, revisitando a soberania das decisões. A metodologia interpretativa, aquela que atrela o Direito e a literatura, como forma alternativa de interpretação jurídica. A pesquisa explora a construção da figura do jurado, passando para compreender pela análise histórica do instituto, bem como da obra machadiana. No entanto, entende-se o direito e a literatura como importante área multidisciplinar capaz de influenciar as implicações sociais e éticas do julgamento humano. Conclui-se, no entanto, que a análise literária do conto permite compreender profundamente as tensões entre moralidade e justiça no contexto jurídico.
The study aims to analyze the importance of the juror in the Jury Court, based on the short story Suje-se Gordo! by Machado de Assis, highlighting the subjectivity in the jury’s decisions and revisiting the sovereignty of verdicts. The interpretive methodology links Law and Literature as an alternative form of legal interpretation. The research explores the construction of the juror figure, seeking to understand it through the historical analysis of the institution as well as Machado’s work. However, Law and Literature are understood as an important multidisciplinary field capable of influencing the social and ethical implications of human judgment. It is concluded that the literary analysis of the story allows for a deeper understanding of the tensions between morality and justice in the legal context.
