Diante de uma realidade tributária de profusão legislativa, inclusive no âmbito do IR, este trabalho analisa a concessão de potencial construtivo por parte do município – a possibilidade de construir acima dos coeficientes estabelecidos – como compensação, tanto pelas limitações urbanísticas de preservação e proteção, impostas aos imóveis, quanto pelas tarefas de conservação e preservação, atribuídas aos seus proprietários; e a eventualidade da incidência tributária na alienação desse potencial. Partindo da noção constitucional de renda como acréscimo patrimonial; considerando a natureza de indenização por dano emergente do potencial construtivo; examinando as possibilidades de tributação das indenizações; bem como a respectiva doutrina e jurisprudência; conclui-se, em princípio, pela não incidência do IR. Confirma-o a única decisão de tribunal conhecida, que, aliás, corrigiu equívoco da primeira sentença; registrando-se que sentenças dessa índole, por não afastarem as incertezas, constituem indícios de crise.

Before the reality of legislative abundance, including the income tax, this work analysis the concession of the construction potential by municipality – the possibility of building above the prescribed coefficients – like a compensation, as by the urbanistic restrictions of preservation and protection to the properties, as by the tasks of conservation and preservation to the owners; and the contingency of tax incidence. Beginning by the constitutional notion of income as patrimonial increment; taking into consideration the indemnity nature by emergent harm of the construction potential; examining the possibilities of indemnities taxation; and the concerning doctrine and jurisprudence; we came to the conclusion, in principle, that we have, here, a hypothesis of no tax incidence. This is confirmed by the only court of justice decision that is known, which, by the way, reformed the first wrong decision; noticing that this kind of decision, doesn’t removing the uncertainties, produces signs of crisis.
