O artigo tem por objetivo realizar uma breve análise legislativa, jurisprudencial e doutrinária sobre a participação da defesa nos atos investigatórios, seja no inquérito policial, sejam em procedimentos realizados por outras autoridades. A análise parte de uma leitura constitucional do inciso XXI, do art. 7º, do Estatuto da Ordem dos Advogados do Brasil (OAB), introduzido pela Lei 13.245/2016, cotejando-o com o projeto de reforma, em curso, do processo penal brasileiro.
This article aims to conduct a brief legislative, jurisprudential and doctrinal analysis on the defense intervention in investigative acts, either in the police investigation, or in procedures performed by other authorities. The overview starts from a constitutional analysis of the article 7, XXI, OAB (Brazilian bar association) Statute, introduced by Law 13.245/2016, comparing it with the ongoing reform project in the realm of the Brazilian criminal procedure law.
