Este artigo aborda os Códigos de Processo Penal português e brasileiro segundo uma metodologia comparativa. Analisa os seus modelos de investigação criminal e de atribuição de funções do Ministério Público. Aponta semelhanças e diferenças entre esses modelos num contexto de estrutura acusatória do processo penal. Avalia as modificações propostas no anteprojeto de Código de Processo Penal brasileiro. Sugere a necessidade de conhecer melhor o Ministério Público português.

This paper approaches the Portuguese and Brazilian Criminal Procedure Codes according to a comparative methodology. It analyzes its models of criminal investigation and functions of the Public Prosecution Service. It points out similarities and differences between these models in a context of accusatory structure of the criminal process of law. It evaluates the modifications proposed in the draft Brazilian Criminal Procedure Code. It suggests the need to know better the Portuguese Public Prosecutor’s Office.
