A relação entre os direitos fundamentais e a realidade do sistema de justiça criminal hodiernamente enfrenta acentuada crise. Em consequências das atribuições do juiz na fase inquisitorial, proferindo ativamente decisões de produção da prova, a imparcialidade subjetiva restaria irremediavelmente afetada, comprometendo, assim, a efetivação das garantias individuais. O presente estudo pretende compreender a figura do “juiz das garantias” como uma exigência do Estado Democrático de Direito.
The relationship between fundamental rights and the reality of the criminal justice system today faces an acute crisis. In consequence of the judge's attributions in the inquisitorial phase, actively pronouncing evidence-taking decisions, a restored impartiality would be irretrievably affected, thereby undermining the effectiveness of individual practices. The present study tries to understand the figure of the "judge of guarantees" as an occurrence of the Democratic Rule of Law.
