O presente trabalho busca entender a Justiça de transição sob o olhar dos direitos humanos e o tratamento dos conflitos posteriores dos regimes militares, à liberalização e democratização no Brasil. Para o objetivo proposto, utilizou-se a metodologia da revisão bibliográfica da obra O Direito Achado na Rua: Introdução Crítica à Justiça de Transição na América Latina partindo-se da problemática dos dilemas e desafios da Justiça de Transição na aplicação do Direito Internacional dos Direitos Humanos em oposição à lei de anistia sobre a tortura, desafiando o entendimento do STF e criminalizando agentes públicos que praticaram crimes de tortura na Ditadura Militar.

Resumo Inglês:

The present work seeks to understand Transitional Justice from the perspective of human rights and the treatment of subsequent conflicts in military regimes, liberalization and democratization in Brazil. For the proposed objective, we used the methodology of bibliographic review of the work O Direito Achado na Rua: Critical Introduction to Transitional Justice in Latin America starting from the problematic of the dilemmas and challenges of Transitional Justice in the application of International Law of Rights Humans in opposition to the amnesty law on torture, challenging the understanding of the Supreme Court and criminalizing public officials who committed crimes of torture in the Military Dictatorship.
