Nesta resenha da tese “Justiça Negociada e Fundamentos do Direito Penal” de Felipe De-Lorenzi, pretende-se descrever as premissas de suas construções e a relevância de suas contribuições, especialmente em relação às propostas de limitações aos acordos sobre a sentença caso inserido no ordenamento brasileiro. Em uma perspectiva crítica construtiva, aponta-se divergência em relação ao papel do juízo no controle do acordo e os problemas de se sustentar um dever de busca da verdade ainda mais em um cenário negocial normalmente realizado em fase investigativa da persecução penal.
This review of “Negotiated justice and criminal law foundations” by Felipe De-Lorenzi describes the premises of its ideas and the relevance of its contributions, especially in relation to the suggestions of limitations to plea bargaining if it is inserted in the Brazilian legal system. In a constructive critical perspective, we point a divergence in relation to the role of the judicial control of the agreement and expose some problems in sustaining a duty to search for the truth even more in negotiations normally carried out in the investigative phase of criminal prosecution.
