O artigo reflete sobre a compatibilidade do uso da Justiça Restaurativa (JR) nos conflitos que envolvem a violência doméstica e familiar contra a mulher. De início, analisa-se a JR como uma Justiça fundada em valores e princípios, que propõe um novo olhar sobre a gestão dos conflitos. O problema questiona a possibilidade de aproximação da Lei Maria da Penha (LMP) de uma interpretação menos restritiva, que dialogue com a JR, compreendendo os desafios e potencialidades que tal aproximação engendra. A partir da hipótese da insatisfação da mulher vítima com a resposta eminentemente retributiva do sistema de justiça criminal, evidenciada nos dados de diversas pesquisas empíricas, o artigo propõe o exercício de analisar a Lei Maria da Penha à luz da Justiça Restaurativa, com vistas à superação do caráter punitivista da lei, atualmente destacado por seus aplicadores. A pesquisa sugere a potencialidade da JR para estimular novos olhares no controle dos conflitos que envolvem violência doméstica e contribuir para empoderar as mulheres vítimas.

The article reflects on the compatibility of using Restorative Justice (RJ) in conflicts involving domestic and family violence against women. At first, it analyzes Restorative Justice as a Justice based on values and principles, which proposes a new look on conflict management. The problem questions the possibility of approaching the Maria da Penha Law (MPL) to a less restrictive interpretation that dialogs with JR, understanding the challenges and potentialities that such approach engenders. From the hypothesis of the dissatisfaction of women victims with the eminently retributive response of the criminal justice system, evidenced in data from several empirical researches, the article proposes the exercise of analyzing the Maria da Penha Law in the light of Restorative Justice, with a view to overcoming the punitive character of the law, currently highlighted by its enforcers. The research suggests the potential of Restorative Justice to stimulate new perspectives in the control of conflicts involving domestic violence, and to contribute to the empowerment of women victims.
