This article analyzes the constitutionality of the new crime incorporated in article 318 bis of the Chilean Penal Code, which sanctions those who knowingly generate the risk of spreading pathological agents in violation of an order from the health authority, in time of pandemic, epidemic or contagion. An analysis of this crime is carried out from a doctrinal and jurisprudential review of the Chilean Constitutional Court regarding the blank criminal laws, category to which this new criminal type corresponds. Special emphasis will have the determination of the nucleus of the punishable conduct, and the reference that article 318 bis makes to infralegal norms of the sanitary authority, to definitively conclude and assume a position based on the main question of constitutionality of the analyzed norm, in light of potential inapplicability requirements that are within the jurisdiction of the Constitutional Court.
Resumo Espanhol:
En el presente artículo se aborda la constitucionalidad del nuevo delito incorporado en el artículo 318 bis del Código Penal chileno, el cual sanciona a quienes generen, a sabiendas, riesgo de propagación de agentes patológicos con infracción de una orden de la autoridad sanitaria, en tiempo de pandemia, epidemia o contagio. Se efectúa un análisis de este delito a partir de una revisión doctrinaria y jurisprudencial del Tribunal Constitucional chileno en torno a las leyes penales en blanco propias, categoría a la cual corresponde este nuevo tipo penal. Especial énfasis tendrá la determinación del núcleo de la conducta punible, y la remisión que el artículo 318 bis efectúa a normas infralegales de la autoridad sanitaria, para en definitiva concluir y asumir una postura en base a la pregunta principal de constitucionalidad de la norma analizada, a la luz de potenciales requerimientos de inaplicabilidad que sean de competencia del Tribunal Constitucional.
