Este artigo procura estabelecer correlações entre a doutrina do Construtivismo Lógico-Semântico e o Pragmatismo, mediante o método de pesquisa bibliográfica. A abordagem é desenvolvida a partir de certos pontos de comparação que foram definidos entre ambos os métodos de investigação do fenómeno jurídico,: (i) o aspecto “construtivista” no Construtivismo Lógico-Semântico; (ii) o tratamento dos conceitos jurídicos oferecidos por ambas as doutrinas; (iii) a extensão da noção de linguagem competente, estabelecida pelo Construtivismo Lógico-Semântico, no sentido da teoria da investigação, proposta por John Dewey, a fim de concluir que o uso da linguagem competente para a construção dos factos jurídicos corresponde ao conceito de asserções garantidas formulado pelo pragmatismo deweyano.

This article seeks to establish correlations between the doctrine of Logical-Semantic Constructivism and Pragmatism, by means of the bibliographic research method. The approach is developed from certain points of comparison that have been defined between both methods of investigation of the juridical phenomenon: (i) what is the “constructivist” aspect in Logical-Semantic Constructivism; (ii) the treatment of the legal concepts offered by both doctrines; (iii) the extension of the notion of competent language, established by Logical-Semantic Constructivism, in the direction of the theory of inquiry, proposed by John Dewey, in order to conclude that the use of competent language for the construction of legal facts corresponds to the concept of warranted assertions formulated by the deweyan pragmatism.
