O presente trabalho tem como objetivo discutir de que forma a teoria do direito, como ciência jurídica, abarca as transformações sociais objetivas e subjetivas que acompanham os movimentos populacionais entre fronteiras nacionais, tendo em vista o papel do Estado nesse contexto. Focaliza-se aqui nas teorias liberal e comunitária, pois o debate entre elas opera em diversos níveis disciplinares, estando bem consolidadas na literatura, além de serem teorias-base para outras abordagens. Por meio de pesquisa bibliográfica, realizou-se uma revisão crítica da literatura referência dentro de ambas as teorias, utilizando-se dos textos originais, daqueles considerados “clássicos”, bem como dos autores mais contemporâneos que buscaram interpretar os clássicos. Intenta-se pontuar as divergências e convergências entre as teorias e refletir sobre como elas podem contribuir para a construção de uma teoria global de justiça, em contraponto às teorias domésticas atuais. Conclui-se que a polarização do debate liberal-comunitarista por si só, não dá conta da complexidade que envolve a migração internacional, sobretudo pelos diversos fatores que motivam o deslocamento humano, além de oferecer respostas simplistas a questões complexas. O pensamento pós-modernista se mostra-se como uma boa alternativa para as novas acepções de justiça nas teorias jurídicas.

This paper aims to discuss how the theory of law, as a legal science, covers the objective and subjective social transformations that accompany population movements across national borders, taking into account the role of the state in this context. The focus here is on liberal and community theories, since the debate between them operates at various disciplinary levels, being well consolidated in the literature, besides being basic theories for other approaches. Through bibliographical research, a critical review of the reference literature within both theories was carried out, using the original texts, those considered “classics”, as well as more contemporary authors who sought to interpret the classics. The intention is to point out the divergences and convergences between the theories and reflect on how they can contribute to the construction of a global theory of justice, in counterpoint to the current domestic theories. We conclude that the polarization of the liberal-communitarian debate alone does not account for the complexity surrounding international migration, especially because of the many factors that motivate human displacement, besides offering simplistic answers to complex issues. The post-modernist thought shows itself as a good alternative to the new meanings of justice in legal theories.
