Não Incidência do PIS e da COFINS sobre Perdão de Dívida da Pessoa Jurídica Devedora

Este artigo busca analisar a incidência da Contribuição para o Programa de Integração Social (PIS) e da Contribuição ao Financiamento da Seguridade Social (COFINS) sobre a receita decorrente do perdão de dívida da pessoa jurídica devedora à luz do regime de incidência das referidas contribuições, das normas vigentes e da jurisprudência administrativa e judicial sobre a matéria, com análise do conceito de receita para fins tributários. O tema é divergente no meio jurídico e está longe de ter a discussão encerrada e, embora a jurisprudência administrativa seja majoritariamente favorável à incidência do PIS e da COFINS por entender que as leis aplicáveis não excepcionam expressamente a tributação em relação ao perdão de dívida, há precedentes tanto em âmbito administrativo e judicial que, com base no conceito de receita já delimitado pelo STF e definido pela doutrina, afastam a tributação justamente porque a receita contábil advinda do perdão de dívida não representa ingresso positivo que incrementa o patrimônio do contribuinte.

This article intends to analyze the assessment of Social Insurance Contributions, denominated PIS and COFINS, on the revenue arising from debt forgiveness registered by debtor legal entity considering the events of levy of these contributions, current legal rules applied, as well as administrative and judicial precedents about this subject, analyzing the concept of revenue for tax purposes. The theme is divergent in the legal environment and is far from having the discussion closed and, although the administrative case law is mostly favorable to the incidence of PIS and COFINS because it understands that the applicable laws do not expressly exclude taxation in relation to the debt forgiveness, there are precedents both in the administrative and judicial levels that, based on the concept of revenue already delimited by the Supreme Court and defined by the doctrine, exclude taxation precisely because the accounting revenue from debt forgiveness does not represent a positive income that increases the taxpayer’s equity.
