O presente artigo traz uma reflexão sobre o quanto a publicidade registral oferecida pelo Registro de Imóveis pode auxiliar na efetividade de medidas ambientais, uma vez que se concentrando todas as informações relevantes ao imóvel e a seus titulares de direitos reais na matrícula do imóvel, o acesso a essa informação é garantido a toda a sociedade. O princípio da concentração, já existente no ordenamento jurídico, dispõe que todos os atos relevantes ao imóvel e aos titulares de direitos reais devem ser centralizados num único ambiente, única forma de se garantir uma verdadeira publicidade dessas informações. No entanto, existe uma série de medidas ambientais que permanecem ocultas e dispersas nos diversos órgãos ambientais e públicos, as quais não alcançam a necessária efetividade.
This article is a reflection on how useful the public records of the Real Estate Registry are for environmental measures. When all the information relevant to real estate and its owners, contained in the registration is concentrated in one place, access to this information is guaranteed to everyone. The principle of concentration already exists in the legal system and it ensures that all events relating to a property and its owners must be centralized in a single place, which is the only way to ensure the availability of such information. However, there are a number of environmental measures that are not included and are spread across various environmental and public agencies, which prevents them from being fully effective.
