Admitindo, por premissa, a estreita relação que há entre os planos processual e material (tributário), o presente texto procura definir em que medida o novo Código de Processo Civil, por seu art. 835, § 2.º, pode implicar a reconstrução de sentido do art. 151, II, do Código Tributário Nacional, dispositivo que prescreve a suspensão, via depósito, da exigibilidade do crédito tributário.

Assuming, by premise, the narrow link between the procedural and substantive levels of law, as for the purpose of this work, between procedural law and tax law, this essay intends to define in which extent the new code of civil procedure of 2015, by its article 835, second paragraph, may imply a meaning reconstruction on the second item of the article 151 of the national tax code purport insofar it prescribes that the cash deposit is able to suspend temporally the tax collection.
