O presente estudo verifica como os mandamentos valorativos político-criminais se inserem na dogmática jurídico-penal, mais especificamente no interior da tipicidade, por meio do princípio da insignificância. Para análise do objeto, utiliza-se de uma combinação metodológica que conjuga os métodos sistemático, tópico-retórico e racional teleológico-funcional. O tema é atual, complexo, controverso e demanda, portanto, pesquisa científica para demonstrar como os valores penetram a estrutura jurídica no âmbito criminal em moldes próximos aos descritos pela corrente Funcionalista.
The present study verifies how the political-criminal value commandments are inserted in the criminal law dogma, more specifically within the typicity, through the principle of insignificance. To analyze the object, a methodological combination is used that matches systematic, topical-rhetorical and rational teleological-functional methods. The theme is current, complex, controversial and demands, therefore, scientific research to demonstrate how values penetrate the legal structure in the criminal sphere in ways close to those described by the Functionalist theory.
