O presente artigo objetiva analisar o conceito jurídico de necessitado e o regi-me jurídico de especial proteção dos indivíduos e grupos sociais (hiper)vulneráveis na Constituição Federal de 1988, notadamente pela ótica da atuação da Defensoria Pública. O regime constitucional de proteção social está diretamente relacionado ao papel delinea-do constitucionalmente para a Defensoria Pública. Tal quadro normativo está fundado, inclusive, por força do princípio da justiça distributiva ou compensatória, na medida em que assegura proteção político-jurídica especial aos indivíduos necessitados e grupos sociais vulneráveis, de modo a alçá-los a um patamar de maior isonomia nas relações que travam com os demais particulares e com próprio Estado, preservando o seu status de cidadão. É, em última instância, o próprio princípio da igualdade que subjaz à assistência jurídica prestadas aos necessitados, tratando determinados indivíduos e grupos sociais de forma desigual, a fim de afirmar (por meio de uma ação política estatal afirmativa) a sua igualdade material no plano político-comunitário. Do contrário, a vulnerabilidade exis-tencial de tais pessoas ocasionada pela privação de direitos implicaria sua marginalização e exclusão social, bem como a total desconsideração da sua autonomia e condição moral e jurídica de sujeito. Também o princípio da solidariedade (ou da fraternidade) é dirigente do atual Estado Social e Democrático e contribui para conformar os deveres jurídicos (do Estado e da sociedade) para com os grupos sociais vulneráveis.

This article aims at analyzing the concept of needy legal status and the legal regime of special protection for (hyper)vulnerable individuals and social groups in the Federal Constitution of 1988, notably from the point of view of the Public Defender’s Of-fice. The constitutional social protection regime is directly related to the role outlined in the Constitution for the Public Defender. This normative framework is based on the principle of distributive or compensatory justice, to the extent that it ensures special political-legal protection for needy individuals and vulnerable social groups, in order to raise them to a level of greater equality in their relations with other individuals and with the State itself, preserving their status as citizens. It is, ultimately, the very principle of equality that underlies the legal assistance provided to the needy, treating certain indivi-duals and social groups unequally in order to affirm (through affirmative state political action) their material equality at the political-community level. Otherwise, the existential vulnerability of such persons caused by deprivation of rights would imply their margina-lization and social exclusion, as well as the total disregard for their autonomy and moral and legal status as subjects. The principle of solidarity (or fraternity) is also the leader of the current Social and Democratic State and contributes to shaping the legal duties (of the State and society) towards vulnerable social groups.
