Cada vez mais o Direito enfrenta desafios sobre como inserir as normas jurídicas provenientes de diversas fontes em um diálogo ativo. Nesse sentido, a integração dos Estados e o compromisso internacional com os direitos humanos têm apresentado grandes desafios. O presente artigo analisa o exemplo do controle de convencionalidade no Sistema Interamericano de Direitos Humanos, valendo-se do diálogo judicial aplicado ao caso Artavia Murillo e outros versus Costa Rica. A metodologia empregada é da pesquisa bibliográfica, centrada na análise do caso julgado. O trabalho conclui identificando o desenvolvimento de uma nova racionalidade jurídica que permite ao Direito acompanhar e amoldar-se à nova realidade, interligando normas internacionais de direitos humanos e o direito interno.

Increasingly, the Law faces challenges on entering the legal rules from different sources in an active dialogue. In this sense, the integration of States and the international commitment to human rights have presented great challenges. This article analyzes the example of control for conformity with the Convention the Inter-American Human Rights System, making use of the transjudicial communication applied to the case Artavia Murillo and others versus Costa Rica. The methodology is the literature search, focusing on the analysis of res judicata. The paper concludes by identifying the development of a new legal rationality that allows the Law to track and to conform to the new reality, linking international human rights and domestic law.
