O presente artigo trata da temática da inclusão digital como condição ao exercício dos direitos fundamentais. Com a ascensão da internet, passou-se a revolucionar a sociedade, tornando-a informacional. Assim, a pesquisa teve como objetivo principal a análise da fundamentalidade do direito à inclusão digital e a verificação desta como pressuposto ao exercício de outros direitos fundamentais. Para tanto, buscou-se resultados ao seguinte problema: quais as condições jurídicas de possibilidade para a inclusão digital ser considerada um direito fundamental? Para a consecução do objetivo proposto, realizou-se uma pesquisa bibliográfica, utilizando-se do método dedutivo para fins de abordagem e monográfico para fins procedimentais. Considerando-se que a pesquisa justifica-se pela necessidade de que se assentem bases à fundamentalidade do direito à inclusão social, passou-se à analisar questões como as desigualdades sociais e a exclusão social na sociedade em rede, para, em um segundo momento, se estudar a inclusão digital como viabilizadora do exercício dos direitos fundamentais. Dentre os resultados, possibilitou-se concluir que, em que pese o surgimento da era digital, esta facilidade ainda não atinge grande parcela da população brasileira, os chamados excluídos digitalmente. Não obstante, a realidade virtual amplia a necessidade de realização de políticas públicas, uma vez que a sociedade está adstrita a processos tecnológicos no seu funcionamento cotidiano. Nesse panorama, a inclusão digital surge como um imperativo social, permitindo que os indivíduos tenham acesso às tecnologias da informação e comunicação, potencializando este instrumento como direito fundamental no ordenamento jurídico brasileiro e viabilizando a participação democrática dos cidadãos na sociedade contemporânea.
This article deals with the theme of digital inclusion as a condition for the exercise of fundamental rights. With the rise of the internet, it has started to revolutionize society, making it informational. Thus, the main objective of the research was to analyze the fundamentality of the right to digital inclusion and its verification as a presupposition to the exercise of other fundamental rights. In order to do so, we sought results to the following problem: what are the legal conditions of possibility for digital inclusion to be considered a fundamental right? In order to achieve the proposed objective, a bibliographical research was carried out, using the deductive method for purposes of approach and monographic for procedural purposes. Considering that the research is justified by the need to lay the foundations for the fundamental right to social inclusion, we began to analyze issues such as social inequalities and social exclusion in a network society, digital inclusion as an enabler of the exercise of fundamental rights. Among the results, it was possible to conclude that, despite the appearance of the digital age, this facility still does not reach a large part of the Brazilian population, the so-called digitally excluded. Nonetheless, virtual reality amplifies the need for the realization of public policies, since society is bound to technological processes in its daily functioning. In this context, digital inclusion emerges as a social imperative, allowing individuals access to information and communication technologies, enhancing this instrument as a fundamental right in the Brazilian legal system and enabling the democratic participation of citizens in contemporary society.
