A origem do Ministério Público ligada à defesa dos interesses do rei e à acusação penal subordinou-o naturalmente ao Poder Executivo; no Brasil, entretanto, o Ministério Público conquistou gradualmente autonomia funcional e seus membros passaram a gozar de independência funcional, tornando-se agentes políticos que tomam as decisões finais de sua atuação funcional subordinados apenas à Constituição e à lei. Entretanto, a liberdade para tomarem suas decisões não os isenta de responderem pelos seus atos, na forma da lei.
The Ministério Público origin, committed to the king's claims defense and to the criminal charge, naturally subordinated it to the Executive Power; however, the Brazilian Ministério Público has gradually gained functional autonomy and its members began to enjoy functional independence, becoming political agents who take the final decisions of their functional performance subordinated only to the Constitution and the law. However, the freedom to take their decisions does not exempt them from responding for their acts, in the form of the law.
