O presente artigo objetiva suscitar a discussão acerca da ocasião exigida para a confissão no Acordo de Não Persecução Penal, explorando tendência jurisprudencial que, no intento de limitar a incidência retroativa do ANPP, impõe a antecedência da confissão à própria oferta, sendo oportuno cotejá-lo com a sistemática do Plea Bargaining, e perscrutar possíveis efeitos deletérios à defesa e à acusação.
The current article aims to raise the discussion about the occasion required for confession in the Criminal Non-Prosecution Agreement, exploring a jurisprudential tendency that, in an attempt to limit the retroactive incidence of the NPA, imposes the advance of the confession to the offer itself, being opportune to compare it with the Plea Bargaining system, and scrutinize possible deleterious effects to the defense and the prosecution.
