The final and binding criminal decision ends the ordinary demand and marks the beginning the execution of prison punishment. Considering this statement, the unification of sentences in case of more than one conviction, the date of the final and binding decision would mark the recount of the period for obtaining future benefits in Criminal Execution. Recently, this jurisprudence was overcome by a new understand. However, some Courts and the Supreme Court keep irreducible, being necessary establish objective criteria for the adoption or not the new jurisprudence. Based on the jurisprudence, applied legislation and doctrine, four criteria are set out so that the final and binding decision is considered a new mark in the execution of prison punishment, they are: the crime need be prior to execution of prison punishment; not be executed in any way; the crime need be less serious crime/punishment than the one in execution; and when the sum of the penalties results in a regression of the prison regime.
