O presente trabalho tem por objetivo apresentar as diferentes espécies de votos que se encontram atrelados à concepção do que atualmente se atende pela expressão “voto de qualidade”. A partir de então, pretende-se identificar a natureza do voto de qualidade previsto no âmbito dos julgamentos do Conselho Administrativo de Recursos Fiscais – CARF, com o objetivo de apresentar, ao final, algumas considerações, de ordem constitucional, pelas quais o voto de qualidade, no âmbito do CARF, viola a imparcialidade do julgamento e, por consequência, o devido processo legal.
Resumo Inglês:
This paper aims to present the different kinds of votes that are linked to the idea of what is currently understanding by the expression “casting vote”. From then on, we intend to identify the legal nature of the casting vote established in the scope of the judgments of the Administrative Tax Appeals Council (CARF), in order to present, lastly, some constitutional considerations, whereby the casting vote in CARF breaches the fairness of the judgment and therefore the due process of law.
