O presente trabalho tem como preocupação os contornos da liberdade. Ele insere a análise sobre a liberdade no contexto da pandemia e das medidas positivadas em lei para contê-la. Isso porque foi veiculado o argumento da liberdade como impeditivo a tais medidas. Por isso, trabalha-se o direito geral de liberdade, a liberdade contratualista, a liberdade positiva e a liberdade negativa, e o papel do dano na perspectiva liberal, para demonstrar a legitimação da restrição da liberdade, através da própria formatação do fundamento da liberdade. Para isso, o estudo constitui-se de uma pesquisa do tipo qualitativa, com objetivo descritivo-explicativo sobre o tema, utilizando para tal o procedimento de pesquisa bibliográfico.

The present paper concern about the contours of liberty. It inserts the analysis of liberty in the context of the pandemic and the measures enacted by law to contain it. This is because the liberty argument was used as an impediment to such measures. Therefore, the general right to freedom, contractual liberty, positive and negative liberty, and the role of harm in the liberal perspective are worked to demonstrate the legitimacy of the restriction of liberty, through the very formatting of the foundation of liberty. For this, the study consists of a qualitative type research, with descriptive explanatory aim for the theme, using the bibliographic search procedure for such.
