O trabalho propõe a garantia de direitos humanos e fundamentais para adolescentes aos quais se atribui a prática de ato infracional e portadores de sofrimento psíquico, e a assunção de responsabilidade político-criminal dos atores do sistema penal brasileiro neste campo, através, em um primeiro momento, da identificação de suas práticas e discursos, e, num segundo momento, de uma reformulação da imputabilidade no direito penal de acordo com o funcionalismo teleológico redutor.
The article proposes the guarantee of human and fundamental rights for Court-involved youth and for mentally disordered offenders, and the assumption of political-criminal responsibility of actors in the Brazilian penal system in this field, through, at first, the identification of their practices and discourses, and, in a second moment, the reformulation of imputability according to teleological-reductive functionalism.
