PARA UMA CRÍTICA DOS DIREITOS HUMANOS NA ERA DA BIOPOLÍTICA

A presente pesquisa possui como principal objetivo realizar uma crítica biopolítica dos direitos humanos. Para sua consecução, foi proposta, em primeiro lugar, a partir de um diálogo com a história do direito, uma genealogia do moderno sujeito de direito, a base jurídico-filosófica da ideia de direitos humanos, e que foi aqui identificada como uma teoria tradicional dos direitos humanos. Depois, buscou-se apresentar, em um segundo momento, as radicais críticas de Karl Marx e de Hannah Arendt quanto a abstratalidade e mera formalidade das declarações de direitos humanos. Por fim, tendo como base sobretudo a contribuição fornecida pelos aportes teóricos de Giorgio Agamben, foi promovida uma crítica dos direitos humanos na era da biopolítica, a qual tem como principal desiderato denunciar as aporias que ficam veladas numa teoria tradicional dos direitos humanos, uma vez que esta possui, como ponto de fuga irretratável, a figura do refugiado, o conceito-limite que põe em radical crise as categorias fundamentais do Estado-nação e a própria ideia de direitos humanos.

This research has as its main objective to carry out a biopolitical critique of human rights. To achieve this, it was first proposed, from a dialogue with the legal history, a genealogy of the modern subject of law, the legal-philosophical basis of the idea of human rights, which was here identified as a traditional theory of human rights. Then, we sought to present, in a second moment, the powerful critiques of Karl Marx and Hannah Arendt regarding the abstractness and mere formality of human rights declarations. Finally, based mainly on Giorgio Agamben’s theoretical contributions, it was promoted a critique of human rights in the era of biopolitics, whose main aim is to denounce the apories that are veiled in a traditional theory of human rights, since it has the figure of the refugee as an irretrievable escaping point, the limit-concept that puts the fundamental categories of the nation-state and the very idea of human rights in a radical crisis.
