Democracia e constitucionalismo são dois fenômenos fundamentais para a solução dos desacordos sociais regulados pelo Direito. De concepções primitivas que envolviam apenas a garantia de voto e a proteção contra a intromissão estatal no âmbito privado, tanto o regime democrático quanto o movimento constitucionalista passaram por importantes transformações nos últimos séculos. Este artigo, por meio de uma revisão bibliográfica a partir do “método” fenomenológico-hermenêutico, pretende investigar a compatibilidade entre democracia e constitucionalismo a partir de quatro objetivos específicos: (i) examinar o que podemos entender como democracia; (ii) compreender o que é o constitucionalismo; (iii) enfrentar a aparente tensão entre a participação popular democrática fundada na regra majoritária e as limitações fundamentais ao debate social impostos pela Constituição; e (iv) analisar por que o Poder Judiciário é imprescindível, no nosso país, para concretizar um modelo substantivo de democracia. A pesquisa defende que há uma relação simbiótica entre a democracia e o constitucionalismo e propõe ser indispensável uma instância especializada como a Justiça para a resolução dos conflitos jurídicos.
Democracy and constitutionalism are two fundamental phenomena for the solution of social disagree-ments regulated by law. From primitive conceptions that involved only the guarantee of vote and the protection against state intervention in the private sphere, both the democratic regime and the con-stitutionalist movement have undergone important transformations in the last centuries. This paper, through literature review under the hermeneutical-phenomenological “method”, intends to investigate the compatibility between democracy and constitutionalism based on four specific objectives: (i) to examine what we can understand as democracy; (ii) to understand what constitutionalism is; (iii) to face the apparent tension between popular democratic participation based on the majority rule and the fundamental limitations to social debate imposed by the Constitution; and (iv) to analyze why the Judiciary is essential, in our country, to enable a substantive model of democracy. The research argues that there is a symbiotic relationship between democracy and constitutionalism and proposes that a specialized body such as the Judiciary is indispensable for the resolution of legal conflicts.
