As reflexões trazidas no presente trabalho têm o escopo de acompanhar, de maneira filosófica, a aplicabilidade da temporalidade fenomenológico-hermenêutica no campo da interpretação do Direito, mais especialmente no âmbito de decisão judicial. Acompanhando a perspectiva heideggeriana, aprofundaremos junto ao caráter próprio de poder-ser do homem para suas possibilidades mais originárias no horizonte da linguagem universal e compartilhada. Colocando sempre em jogo a constituição histórica do Dasein, a investigação percorrerá, fenomenologicamente, o campo de disposição articulado por sentidos históricos dos entes que vêm à fala, procurando evidenciar como estes se mostram determinados, na temporalidade, ante as mesmas possibilidades dos modos de ser da interpretação do julgador.
The reflections brought up in this work have the scope to follow, in a philosophical way, the applicability of the phenomenological-hermeneutic temporality in the field of the interpretation of the law, more especially in the scope of judicial decision. Accompanying the Heideggerian perspective, we will deepen together with the characteristic of man’s power-to-be to its most original possibilities in the horizon of universal and shared language. Bringing into play the historical constitution of Dasein and its condition of being abruptly released into the world, the investigation will phenomenologically cover the field of disposition articulated by the historical meanings of the entities that come to the speech, seeking to show how these determine, in temporality, the possibilities of the ways of being of the judge’s interpretation.
