Este trabalho tem como objetivo analisar a possibilidade de compensar créditos que servidores públicos estaduais, em especial de São Paulo, possuam em face da fazenda estadual, com o valor devido a título de imposto de renda. Para tanto, parte da evolução da teoria da responsabilidade do Estado desde a irresponsabilidade do período Absolutista até o surgimento do precatório e sua evolução histórica. Em paralelo, aborda o instituto da compensação, tanto na esfera privada quanto no âmbito do direito tributário. Nesse cenário, utilizando-se dos posicionamentos dos tribunais superiores e dos principais ramos do direito público (constitucional, administrativo, tributário e financeiro) e seus princípios básicos, conclui pela possibilidade de criação de diploma estadual contemplando a compensação em exame à luz da repartição constitucional de receitas.

This work aims to analyze the possibility of offset credits that state civil servants, especially in São Paulo, have in the face of state farm with the amount due by way of income tax. Therefore, part of the evolution of state responsibility theory from the irresponsibility of the absolutist period until the emergence of the debt security and its historical evolution. At the same time, it addresses the compensation Institute, both in the private sphere as in the tax law. In this scenario, using the positions of the superior courts and the main branches of public law (constitutional, administrative, tax and financial) and its basic principles, he concludes the possibility of state law creating contemplating taking on compensation in the light of the constitutional division revenues.
