PRESTAÇÕES POSITIVAS DO ESTADO NA SOCIEDADE DA INFORMAÇÃO: DIREITO À EDUCAÇÃO E A PANDEMIA DE COVID-19

O presente artigo foi elaborado no âmbito de pesquisa desenvolvida no âmbito do Grupo de Pesquisa “Direito constitucional na sociedade da informação” do Centro Universitário das Faculdades Metropolitanas Unidas, São Paulo, Brasil, dentro da linha de pesquisa Sociedade da Informação. No presente artigo teve-se por escopo analisar as prestações positivas do Estado, em especial, a educação e a falta de comprometimento na melhoria desse direito fundamental, em especial, durante a pandemia de Covid-19. Para tanto, foram analisados documentos disponibilizados publicamente pela internet, livros, outros artigos científicos sobre o tema, acórdãos e jurisprudências. A pesquisa é de base bibliográfica documental e foi desenvolvida a partir do raciocínio indutivo. Concluiu-se que o Estado tem feito uso da Reserva do Possível como forma de se abster de suas obrigações constitucionais, sem se atentar para garantir o mínimo existencial. O Estado deveria aumentar os investimentos em educação, visto que a média no índice de desenvolvimento de educação básica tem diminuído nos últimos anos, bem como deveria dar diretrizes básicas para o ensino domiciliar, como forma de garantir o mínimo existencial, com referência ao direito à educação.

The present article was prepared within the scope of the research developed within the Research Group “Constitutional Law in the Information Society” of the University Center of Faculdades Metropolitanas Unidas, São Paulo, Brazil, within the Information Society research line. The purpose of this article was to analyze the positive obligations of the State, especially education and the lack of commitment to improving this fundamental right, especially during the Covid-19 pandemic. To this end, documents made publicly available on the internet, books, other scientific articles on the subject, judgments and jurisprudence were analyzed. The research is based on documentary bibliography and was developed based on inductive reasoning. It was concluded that the State has made use of the Reserve for Contingencies as a way to abstain from its constitutional obligations, without paying attention to guarantee the existential minimum. The State should increase investments in education, since the average in the basic education development index has decreased in recent years, as well as it should provide basic guidelines for home education, as a way to guarantee the existential minimum, with reference to the right to education.
