O emprego de presunções e ficções no Direito Tributário, embora possível e até útil, exige extrema cautela, haja vista as limitações constitucionais ao Poder Estatal de tributar. Essa prática demanda maior atenção ainda na definição da base de cálculo do ICMS exigido sob a sistemática da substituição tributária progressiva, terreno fértil aos abusos praticados pelos Estados. O estudo volta-se à análise das presunções e ficções no direito tributário e, especificamente, à definição da base de cálculo do ICMS-ST, diferenciando a base de cálculo presumida daquela ficcional, a caracterizar pauta fiscal lesiva ao contribuinte e inconstitucional.

The use of presumptions and fictions in Tax Law, although possible and even useful, requires extreme caution, given the constitutional limitations on State power to tax. This practice requires more attention in the definition of the ICMS (IVA) required under the system of progressive tax substitution, fertile ground for abuse. This study analyzes presumptions and fictions in tax law and, specifically, the definition of the ICMS (IVA) tax base, differentiating the presumed basis of fictional basis, which configures price fixing for taxation purposes, affects the taxpayer and is unconstitutional.
