A PRIORIZAÇÃO DA VACINAÇÃO CONTRA COVID-19 DAS MULHERES EM SITUAÇÃO DE CÁRCERE: O DIREITO FUNDAMENTAL À SAÚDE

O presente trabalho traz à baila reflexões pautadas na vulnerabilidade das Mulheres Privadas de Liberdade do sistema prisional do Estado do Rio de Janeiro no que concerne a crise sanitária mundial ocasionada pelo vírus COVID-19 (SARS-CoV-2) e as políticas públicas adotadas capazes de conter a propagação do vírus e garantir os direitos fundamentais a esse grupo de vulneráveis. Sob este prisma, diante da implacável crise sanitária, compete ao Estado a responsibilities de promover políticas públicas de forma efetiva que possam permitir o acesso a saúde e mitigar a insalubridade das mulheres em situação de privação de liberdade no sistema prisional. O crescente contingente de infectados, bem como a célere disseminação do vírus traz a identificação de situações de vulnerabilidade na qual as mulheres em situação de privação de liberdade são inseridas. O direito à saúde é garantido a todos, logo, as mulheres em situação de cárcere são mais suscetíveis a contaminação, haja vista que em nosso sistema prisional há violações às garantias previstas constitucionalmente. Por essa razão, é de suma importância que o Estado promova como política de enfrentamento à pandemia a priorização do grupo de Pessoas Privadas de Liberdade para recebimento da vacina através do Plano Nacional de Operacionalização da Vacinação contra COVID-19.

The present work brings up reflections based on the vulnerabilities of Women Deprived of Liberty of the prison system of the State of Rio de Janeiro not concerning the global health crisis caused by the COVID-19 virus (SARS-CoV-2) and the public policies adopted by the State, capable of containing the spread of the virus and guaranteeing fundamental rights to this group of vulnerable people. From this point of view, given the relentless health crisis, it is the State’s responsibility to promote public policies in an effective way that can allow the access to health and mitigate the unhealthiness of women deprived of liberty in the prison system. The growing contingent of infected, as well as the rapid spread of the virus leads to the identification of situations of vulnerability in which women deprived of liberty are inserted. The right to health is guaranteed to all, therefore, as women in prison situations are more susceptible to contamination, considering that in our prison system there are violations of the guarantees provided by the Constitution. For this reason, it is of the utmost importance that the State promote, as a policy of confronting the pandemic, the prioritization of the group of Persons Deprived of Liberty to receive the vaccine through the COVID-19 Vaccination Operationalization National Plan.
