Considerando o contexto de constante mudanças tecnológicas e o desenvolvimento constante no fluxo infinito da chamada “sociedade da informação”, o Direito passa a tratar de uma nova fronteira: a necessidade de proteção específica para dados pessoais, a fim de se garantir direitos fundamentais já consagrados como a liberdade, privacidade e outros desenvolvidos em um plano recente, como a autodeterminação informacional e o livre desenvolvimento da personalidade. Este trabalho possui caráter exploratório e busca apresentar, através de uma discussão envolvendo a norma constitucional brasileira, a Lei Geral de Proteção de Dados de 2018 e demais fontes relevantes à temática, as possíveis interações da temática para com a proteção de direitos fundamentais, com destaque para hipóteses de aplicação da teoria da eficácia horizontal dos direitos fundamentais. Serão apontados fundamentos legislativos trazidos pela LGPD, bem como o papel que a norma infraconstitucional assume em nosso sistema jurídico nacional. No desenvolvimento deste trabalho, foram empregados os métodos dedutivo e bibliográfico, em busca de uma explanação atinente à técnica-dogmática do direito. Foram utilizadas enquanto bases teóricas fundamentais as fontes jurídico-formais de pesquisa, incluindo os acervos de leis e obras de júris-filósofos, doutrinadores e pesquisadores das áreas jurídicas e também áreas correlatas que permeiam o tema, com atenção especial ao tratamento nacional da matéria.

Considering the context of constant technological changes and the ever-changing development in the infinite flow of the so-called “information society”, the legal science starts to deal with a new frontier: the need for specific protection for personal data, in order to guarantee well known fundamental rights such as freedom, privacy and new ones developed for a new model of society, such as the informational self-determination and the free development of the personality. This work is exploratory and seeks to present, through a discussion involving the Brazilian Constitution, the Brazilian General Data Protection Law of 2018 and other relevant sources to the theme, the possible interactions of the theme with the protection of fundamental rights, with emphasis on chances of applying the theory of the horizontal effectiveness of fundamental rights. Legislative foundations brought by the LGPD will be pointed out, as well as the role that the infraconstitutional norm assumes in our national legal system. In the development of this work, deductive and bibliographic methods were employed, in search of an explanation related to the legal dogmatic technique. Legal-formal sources of research were used as fundamental theoretical bases, including the collections of laws and works of juries-philosophers, legal professors and researchers, as well as related areas that permeate the theme, with special attention to the national treatment of the matter.
