Proteção e incentivo a whistleblowers nos Estados Unidos: um modelo a ser seguido?

A proteção à figura do whistleblower tem longa história em outros países, principalmente nos Estados Unidos. No Brasil, há projetos de lei para regulamentar proteções aos whistleblowers, mas há poucos estudos acerca da experiência estrangeira e os impactos do incentivo aos denunciantes. Por meio de revisão bibliográfica, o presente artigo estudou as principais normas de proteção e incentivo a whistleblowers nos Estados Unidos: Whistleblower Protection Act, Sarbanes-Oxley Act e Dodd–Frank Wall Street Reform and Consumer Protection Act. A partir dessas normas, foram traçados breves contornos acerca de um conceito de whistleblower, realizada uma análise crítica do instituto nos Estados Unidos e concluído que naquele país a proteção aos whistleblowers está relacionada à proteção ao mercado de capitais. Por fim, comparou-se a finalidade da proteção e incentivo ao whistleblower no Brasil com a finalidade dos Estados Unidos, ressaltando as diferenças e trazendo questionamentos acerca da conveniência do estímulo ao whistleblower no Brasil.

Resumo Inglês:

The protection of whistleblowers has a long history in several countries, especially the United States. In Brazil, there are draft laws that propose the regulations of whistleblower protections, but there are few studies about foreign experience and the impacts of encouraging whistleblowers. Through a bibliographic review, this article studied the main laws that protect and encourage whistleblowers in the United States: Whistleblower Protection Act, Sarbanes-Oxley Act and Dodd-Frank Wall Street Reform and Consumer Protection Act. The article also briefly drafted a whistleblower concept, carried out a critical analysis of the institute in the United States and concluded that in that country the protection of whistleblowers is related to the protection of the capital markets. Finally, compared the purpose of the protection and encouragement of whistleblowers in Brazil with the United States’s purpose, highlighting the differences and raising questions about the suitability of the whistleblower encouragement in Brazil.
