Dada a dinâmica processual em que os indivíduos sofrem intervenções em seus direitos e garantias sem qualquer contraponto defensivo, este artigo trata da proposta de instituição da protodefensoria, isto é, de um departamento público, dentro da Defensoria Pública, responsável por postular pela proteção dos dados pessoais, quando da persecução penal por meio de métodos ocultos, ou seja, de expedientes investigatórios realizados sem o conhecimento das pessoas afetadas.
Given the procedural dynamics in which individuals undergo interventions in their rights and guarantees without any defensive counterpoint, this article deals with the proposal for the institution of protodefense, that is, a public department, within the Public Defender ’s Office, responsible for advocating for the protection of personal data, when criminal prosecution is carried out by means of hidden methods, that is, of investigative expedients carried out without the knowledge of the people affected.
