Voltado à salvaguarda dos bens jurídicos mais caros à sociedade, o Direito Penal exsurge como derradeira saída, prevendo as consequências mais severas à sua transgressão. Nesse contexto, ganha relevo a figura do psicopata, que detém perfil propenso ao desafio das leis, vulnerando toda sorte de direitos alheios e se mostrando es-pecialmente resistente à modificação deste padrão comportamental. Assim, utilizando como metodologias básicas a pesquisa bibliográfica e documental, foram objetivos deste trabalho: 1. analisar as possíveis respostas estatais às condutas delitivas perpetradas por psicopatas, na conjuntura jurídico-normativa brasileira atual; 2. verificar se essas respostas se mostram compatíveis com os conhecimentos científicos disponíveis acerca das características próprias destes indivíduos. Como resultado, foi possível concluir: 1. pela imputabilidade dos psicopatas, de acordo com os critérios adotados pelo Código Penal; 2. pela imposição de penas como resposta mais adequada para este tipo de infrator, embora ainda ineficaz para, por si só, prevenir a reincidência.
Criminal Law exists as the ultimate mechanism, focused at safeguarding the dearest legal assets of society. Within this, the figure of the psychopath gains prominence, in that it has a profile prone to challenging the laws and is especially resistant to the modification of such behavioral pattern. Thus, using as basic methodologies the bibliographic and documentary research, this work aspires: 1. to analyze possible state responses to the delinquency behavior perpetrated by psychopaths, in the current Brazilian juridical-normative conjuncture; 2. to verify whether possible answers are compatible with the scientific knowledge about the characteristics of these persons. As a result it was possible to conclude: 1. for the imputability of psychopaths, according to the criteria adopted by the Penal Code; 2. for the imposition of penalties as a more adequate response for this type of offender, although still ineffective in order to, by themselves, prevent their recidivism.
