Com o objetivo de avançar no debate sobre o reconhecimento fotográfico como prova nos processos criminais, o artigo apresenta um mapeamento das principais produções que levantaram os problemas de tal prática, especialmente a partir dos estudos da Defensoria Pública do Rio de Janeiro e de organizações da sociedade civil. Depois, sistematiza os principais avanços institucionais recentes sobre o tema, em especial a jurisprudência do Superior Tribunal de Justiça e os trabalhos do Conselho Nacional de Justiça, que estabelecem parâmetros a serem seguidos no momento da realização do reconhecimento de pessoas. Por fim, o texto aponta como tal debate pode ajudar a avançar no tema mais amplo do controle democrático das práticas policiais, muitas vezes arbitrárias.
With the aim of advancing the debate on photographic recognition as evidence in criminal proceedings, the article presents a mapping of the main productions that raised the problems of such practice, especially from the studies of the Public Defender ’s Office of Rio de Janeiro and civil society organizations. Then, it systematizes the main recent institutional advances on the subject, especially the jurisprudence of the Superior Court of Justice and the works of the National Council of Justice, which establish parameters to be followed at the time of carrying out recognition of people. Finally, the text points out how such debate can help advance the broader theme of democratic control of police practices, which are often arbitrary.
