Na cultura digital típica da pós-modernidade as novas mídias e a Internetampliam o alcance do exercício da liberdade de expressão que está diretamenterelacionado à abertura e ao acesso propiciados pelo direito à informação e àcomunicação; na medida em que ampliam processos tecnológicos de digitalização,as novas mídias e a Internet elevam a novo patamar de evolução a construção dasocialidade e da democracia. Nesse contexto, é necessário identificar o modo comoo princípio proprietário pode interferir na ampliação do acesso ao direito à informaçãoe à comunicação e, com isso, repercutir no exercício da liberdade de expressão nacultura digital. Em três momentos distintos, mas complementares, tenta-se identificara dialética que subjaz aos processos de evolução social na cultura digital da sociedadepós-moderna; no início, discute-se as aberturas e os impasses propiciados pela culturadigital; depois, volta-se para os paradoxos na construção do direito à informação e àcomunicação e sua relação com a liberdade de expressão; no fim, procura-se situar arelação entre direito de propriedade e direito à informação e à comunicação.

In typical postmodernity’s digital culture, new media and the Internetextend the reach of freedom of expression that is directly related to openness andaccess propitiated the right to information and communication, to the extent thatenhance technological processes of scanning, new media and the Internet raise newlevel of evolution of sociality and the construction of democracy. In this context, it isnecessary to identify how the principle owner may interfere with the expansion of theright of information and communication and, therefore, impact on freedom of expressionin digital culture. On three separate but complementary, attempts to identify the dialecticthat underlies the processes of social evolution in the digital culture of the postmodernsociety, in the beginning, we discuss the gaps and bottlenecks resulting of the digitalculture, then back- if to the paradoxes in the construction of the right to information andcommunication and its relation to freedom of expression in the end, try to situate therelationship between property rights and right to information and communication.
