A educação, além de ser um direito social constitucionalmente garantido no Brasil, também afeta a realidade carcerária do país através do instituto da remição por estudo. Este tem por função diminuir a pena recebida pelo agente em razão de horas de estudo no cárcere. Nesse contexto, o presente estudo busca compreender, através de julgados do Tribunal de Justiça do Rio Grande do Sul – TJ/RS, como o sistema judicial brasileiro utiliza a ferramenta de (re)inserção social da remição por estudo no que se refere a apenados de regime fechado que tenham a intenção de acessar a Educação Superior. Neste estudo foi realizada uma pesquisa bibliográfica-documental de caráter qualitativo, com doutrinas em matéria penal e processual penal, como fonte principal de referencial teórico, somado à pesquisa jurisprudencial sobre o tema no site oficial do TJ/RS. Assim, discorreu-se sobre o instituto da remição por estudo, correlacionando-o com o viés ressocializador da educação. Finalmente, apresentou-se o perfil do encarcerado no estado do Rio Grande do Sul e discutiu-se, a partir dessa realidade, julgados do TJ/RS que tratam da possibilidade de remição por estudo em estabelecimento de Educação Superior para o encarceraddo no regime fechado. Dessa forma, concluiu-se haver uma instabilidade por parte do Judiciário em aplicar com segurança o instituto da remição por estudo, especialmente, no que diz respeito ao apenado de regime fechado que busca a Educação Superior.

Education, in addition to being a constitutionally guaranteed social right in Brazil, also affects the country’s prison reality through the remission institute by study. This has the function of decreasing the penalty received by the agent due to hours of study in prison. In this context, the present study seeks to understand, through judgments of Rio Grande do Sul Court of Justice - TJ/RS, how the Brazilian judicial system uses the tool of social (re)insertion of the remission by study regardin to closed regime prisioners that intend to access Higher Education. In this study, it was made a qualitative bibliographic-documental research, with criminal and criminal procedural matters doctrines, as the main source of theoretical reference, added to the jurisprudential research on the topic on the TJ/RS official website. Thus, we discussed the institute of remission by study, correlating it with the resocializing bias of education. Finally, the Rio Grande do Sul’s prisioner profile is presented and, based on this reality, TJ/RS sentences who deal with the possibility of remission by study in a Higher Education establishment for the closed regime prisoner were discussed. Thus, it was concluded that there is an instability on the part of the Judiciary to safely apply the remission institute by study, especially regarding to the closed regime convicts that seeks Higher Education.
