O presente artigo, à luz da Teoria do Delito, visa discutir aspectos do conceito de culpabilidade no âmbito da pessoa jurídica. Para tanto, indaga-se sobre o fundamento de responsabilidade social utilizado pelo Superior Tribunal de Justiça na imposição da sanção penal à pessoa jurídica, confrontando tal concepção com as características da culpabilidade aplicável às pessoas físicas. Como resultado, reconhece-se que o fundamento pelo qual se considera uma pessoa jurídica respónsável por infrações penais não é culpabilidade em sentido estrito, mas sim outra categoria dogmática análoga ou equivalente, mas que com ela não se confunde.
This article, in the light of the Theory of Crime, aims to discuss aspects of the concept of culpability within the scope a legal entity. For this purpose, it is asked about the basis of social responsibility used by the Superior Tribunal of Justice in the imposition of the criminal sanction on the legal entity, comparing this conception with the characteristics of culpability applicable to individuals. As a result, it is recognized that the basis on which a legal entity is considered responsible for criminal offenses is not culpability in the strict sense, but another analogous or equivalent dogmatic category, not to be confused with it.
