O presente artigo pretende analisar as possibilidades de revisãoconstitucional pretendidas através de emendas constitucionais convocadoras deassembleias de revisão que tramitam no Congresso Nacional, à luz da legalidade e dalegitimidade. Todas as considerações tecidas ao longo do texto tomarão a revisãopretendida em contraponto com a legalidade em seus aspectos formais - poderconstituinte originário e derivado, e materiais: direitos sociais como fundamentais,frente à legitimidade. Para tanto, considerar-se-ão os postulados do processolegislativo democrático, consentâneo salutar do Estado Democrático de Direito.

This article will analyze at least the possibility of constitutional changesought through constitutional amendments called by assemblies of review that debatedby Congress, in the light of legality and legitimacy. All points made throughout thetext take the desired revision, against the legality of its formal aspects - primary andsecondary constituent power, and materials: how fundamental social rights, in front oflegitimacy. To this end, shall consider the postulates of the democratic legislativeprocess, in keeping healthy democratic rule of law.
