Ao completar 30 anos da promulgação da Constituição Federal Brasileira de 1988 busca-se fazer uma reflexão sobre o seu processo de elaboração iniciado em fevereiro de 1987, em especial, para a elaboração desta pesquisa, os debates sobre a tutela do meio ambiente, os quais resultaram na inserção de um capítulo próprio dedicado ao tema. Baseado neste intento, revisitando os trabalhos da Comissão da Ordem Social e, principalmente, da Subcomissão da Saúde, Seguridade e Meio Ambiente, procurou-se entender os principais argumentos norteadores da constitucionalização da tutela ambiental, tornando-o baliza para uma série de normas ambientais elaboradas neste período. Este artigo está baseado em revisão bibliográfica e análise de fontes primárias, como os anais da constituinte de 1987/88, alinhada aos critérios qualitativos da pesquisa científica de forma dedutiva, procurando estabelecer as bases para o processo de constitucionalização da matéria ambiental.
The thirty-year anniversary of the promulgation of the Brazilian Federal Constitution of 1988 seeks to reflect on its elaboration process begun in February 1987, especially for the elaboration of this research, the debates on the protection of the environment, which resulted in the insertion of a dedicated chapter dedicated to the theme. Based on this intention, revisiting the work of the Social Order Commission and, especially the Subcommittee on Health, Safety and Environment, we sought to understand the main guiding arguments for the constitutionalization of environmental protection, making it the target for a series of environmental standards elaborated in this period. This article is based on bibliographic review and analysis of primary sources, such as the annals of the 1987/88 constituent, aligned to the qualitative criteria of scientific research in a deductive way, seeking to establish the basis for the process of constitutionalisation of the environmental matter.
