A Convenção Internacional sobre Padrões de Instrução, Certificação e Serviço de Quarto para Marítimos (STCW) vincula que seus Estados signatários organizem serviços de quarto, em navios classificados para mar aberto, de modo a prevenir a fadiga laboral e preservar o descanso dos marítimos que estejam envolvidos em funções relacionadas a atribuições de segurança, prevenção da poluição e proteção da embarcação. O presente artigo tem como objetivo geral investigar a ocorrência fadiga laboral em oficiais mercantes brasileiros, a bordo de embarcações mercantes. Foi utilizado o método de abordagem dedutivo, recorrendo a levantamentos documentais e bibliográficos, além de entrevistas semiestruturadas, por meio da plataforma “Google Forms”, objetivando investigar o atual panorama do repouso do oficial mercante brasileiro, que trabalha, ou trabalhou no Brasil. O trabalho foi dividido em três seções, além da introdução e conclusão, tratando, respectivamente, do fenômeno da fadiga laboral contemporânea, das causas e impactos da fadiga laboral no mar e os resultados obtidos por meio do questionário aplicado, o qual apontou que 54% dos participantes declararam não ter adequado repouso a bordo, 61% costumam dormir seis horas ou menos e a maior parte deles relatou a incidência pouco frequente de sintomas de fadiga, entre outros dados que indicam a necessidade de medidas que protejam os direitos de repouso dos oficiais brasileiros.

The International Convention on Standards of Instruction, Certification and Watching for Seafarers (STCW) commits its signatory States to organize watchkeeping on ships classified for open sea, in order to prevent labor fatigue and preserve the rest of seafarers who are involved in functions related to safety, pollution prevention and vessel protection attributions. This article aims to investigate the occurrence of labor fatigue in Brazilian merchant officers, on board merchant vessels. The method of deductive approach was used, using documentary and bibliographic surveys, in addition to semi-structured interviews, through the “Google Forms” platform, aiming to investigate the current panorama of the rest of the Brazilian merchant officer, who works or worked in Brazil. The work was divided into three sections, in addition to the introduction and conclusion, dealing, respectively, with the phenomenon of contemporary work fatigue, the causes and impacts of work fatigue at sea and the results obtained through the applied questionnaire, which indicated that 54% of the participants reported not having adequate rest on board, 61% usually sleep six hours or less and most of them reported the infrequent incidence of fatigue symptoms, among other data that indicate the need for measures to protect the rest rights of Brazilian officers.
