Resumo: O presente artigo pretende verificar se a teoria da cegueira deliberada foi objeto de discussão pelo Supremo Tribunal Federal no julgamento da Ação Penal 470, analisando o posicionamento dos Ministros a respeito do tema e os fundamentos utilizados para afastar, ou justificar, a aplicação da referida teoria no caso do Mensalão. Assim, tendo em vista os argumentos referidos pelos Ministros, bem como os construídos pela doutrina a respeito da teoria da cegueira deliberada, procurar-se-á realizar uma análise crítica da referida teoria, analisando seus fundamentos e eventuais equívocos dogmáticos, questionando a possibilidade da sua aplicação no ordenamento jurídico-penal brasileiro. Dessa forma, o presente artigo tem como objetivo analisar a problemática que pode encerrar a aplicação da teoria da cegueira deliberada no direito brasileiro diante da nebulosa relação entre os conceitos de cegueira deliberada, dolo eventual e culpa consciente.

Abstract: This article aims to verify if the theory of willful blindness was subject of discussion by The Supreme Court in the Trial of Criminal Action 470, analyzing the position of Ministers about the theme and the grounds used to ward off, or justify the application of the theory in the case of Mensalão. Thus, having in mind the arguments referred by the Ministers, as well as those built by the doctrine about the theory of willful blindness, we Will try to make a critical analysis of the theory, analyzing its fundamentals and any dogmatic misconceptions, questioning the possibility of their application the Brazilian legal – criminal law. Thereby, this article aims to analyze the problems that the application of the theory of willful blindness in Brazilian law may contain due to the nebulous relationship between the concepts of willful blindness, eventual deceit and conscious guilt.
