O presente artigo analisa a possibilidade de aplicação de um compartilhamento de deveres alimentares, quando instituído o regime de guarda compartilhada. O problema resulta da inadequação entre os deveres dos pais no cuidado compartilhado com o filho e a persistente e conservadora compreensão de que o pai como provedor deve assumir integralmente os deveres alimentares. O critério ainda é o mesmo da composição da guarda unilateral. Sugere-se critérios de definição do compartilhamento dos alimentos conforme as possibilidades de cada genitor, ponderando sobre as despesas resultantes nas responsabilidades na guarda, considerando o posicionamento doutrinário vigente, unificado com os princípios da prioridade absoluta e do melhor interesse da criança e do adolescente, e como técnica principal foi utilizada a metodologia dedutiva e o métodos bibliográfico e jurisprudencial, dando ênfase aos posicionamentos do TJDFT, tribunal escolhido para análise, pelas suas teses consideradas alinhadas ao novo paradigma familiar.

The present article seeks to analyse the possibility of applying a sharing of maintenance duties, when the regime of shared custody is instituted. The problem results from the inadequacy between the duties of parents in the shared care with the child and the persistent and conservative understanding that the father as the provider must fully assume the maintenance duties. The criterion is still the same of the composition of the unilateral custody. It seeks to suggest criteria to define the sharing of food according to the possibilities of each parent, pondering on the expenses resulting from the responsibilities in the custody, considering the doctrinaire position in force, unified with the principles of absolute priority and of the best interest of the child and the 94 Revista de Estudos Jurídicos UNESP, a.24, n.40, 2020adolescent and as main technique the bibliographical and jurisprudential method was used, giving emphasis to the positions of the TJDFT, court chosen for analysis, because of its theses considered in line with the new family paradigm.
