O presente estudo tem como objetivo analisar a relação entre os direitos humanos e a proteção da população lésbica, gay, bissexual, transexual e travesti, queer, assexual e intersexual (LGBTQIA+) no âmbito jurídico e social, com enfoque nas políticas públicas brasileiras. A pesquisa, de caráter documental, examina legislações, resoluções e documentos institucionais que abordam a garantia de direitos e o combate à discriminação dessa população. Considera-se a atuação do Conselho Federal de Psicologia, do Ministério da Saúde e de órgãos de direitos humanos na promoção da cidadania e na construção de protocolos específicos para o atendimento dessa comunidade. A análise revela avanços normativos e desafios na implementação efetiva dessas políticas, destacando a persistência da violência e da desigualdade estrutural. Conclui-se que, embora haja marcos legais relevantes, a efetivação dos direitos da população LGBTQIA+ ainda depende de ações intersetoriais e da superação de barreiras culturais e institucionais. O estudo contribui para o debate sobre a necessidade de fortalecimento das políticas públicas inclusivas e da responsabilização dos agentes públicos na garantia dos direitos fundamentais.
This study aims to analyze the relationship between human rights and the protection of the LGBTQIA+ population within the legal and social framework, focusing on Brazilian public policies. This documentary research examines legislation, resolutions, and institutional documents addressing the guarantee of rights and the fight against discrimination against this population. It considers the role of the Federal Council of Psychology, the Ministry of Health, and human rights organizations in promoting citizenship and developing specific protocols for attending to this community. The analysis reveals regulatory advances and challenges in effectively implementing these policies, highlighting the persistence of violence and structural inequality. The study concludes that, although there are significant legal frameworks, the effective enforcement of LGBTQIA+ rights still depends on intersectoral actions and overcoming cultural and institutional barriers. This research contributes to the debate on the need to strengthen inclusive public policies and hold public agents accountable for ensuring fundamental rights.
