O presente trabalho pontua a inovação legislativa operada pela Lei nº 14.344/22 (Lei Henry Borel), que traz, em seu bojo, a definição de violência doméstica contra crianças e adolescentes, e se espraia pelo Código Penal e pela Legislação Extravagante (com novas causas de aumento de pena se qualificadoras), bem como na inserção de novas figuras penais, com vistas a contemplar uma maior proteção àqueles, vulneráveis por natureza, ainda que, no período de vacatio legis, a eficácia social da norma seja um tema que ultrapassa os meandros do Direito Penal Simbólico.

The present work points out the legislative innovation operated by Law no. 14.344/22 (Henry Borel Law), which brings, in it’s core, the definition of domestic violence against children and adolescents and which spreads through the Penal Code and the Extravagant Legislation (with new causes of violence increase in penalties and qualifiers), as well as the insertion of new penal figures, with a view to providing greater protection to those, who are vulnerable by nature, even if, in the period of vacatio legis, the social effectiveness of the norm is a theme that goes beyond the intricacies of the Symbolic Criminal Law.
