O artigo aborda a valorização da função social dos cartórios por meio dos instrumentos extrajudiciais que o poder legiferante tem disponibilizado para a sociedade civil. Para tanto, foi realizada uma sucinta revisão do estado da questão das teorias possessórias abraçadas pelo sistema legal pátrio, bem como revistas as diversas espécies e características desse importante instituto de aquisição de propriedade. Potencialmente, a usucapião extrajudicial pode minorar as consequências nefastas causadas pela falta de regularização fundiária, que diminuem a segurança jurídica, dificultam o acesso ao crédito e promovem o aumento do risco e da taxa de juros cobrados nos negócios imobiliários.

The article discusses the valuation of the social function of the registry offices through extra-judicial instruments that legislating power has made available to civil society. Therefore, a brief review of the state of affairs of possessory theories embraced by parental legal system was carried out and reviewed the various types and characteristics of this important property acquisition Institute. Potentially, the extra-judicial usurpation can minimize the negative consequences caused by the lack of land tenure, which reduce legal certainty, difficult access to credit and promote the increased risk and the interest rate charged in the real estate business.
