A vaquejada carrega consigo base cultural forte, contrapondo-se à obrigação estatal de proibição às práticas que submetam os animais à crueldade. Objetivou--se um perpasse sobre os institutos da vaquejada e do efeito backlash, em face da legislação atinente e possibilidade de ocorrência deste. Abordou-se, criticamente, o exercício do poder judicante quando da condução processual da Ação Direta de Inconstitucionalidade n.º 4.983, ausente de legitimação social, acarretando no efeito retromencionado. Por fim, teceram-se considerações à ponderação principiológica realizada pelo Supremo Tribunal Federal brasileiro na colisão principiológica atinente ao caso que trata sobre direitos fundamentais coletivos utilizando-se preponderantemente a Teoria do Sopesamento de Robert Alexy. O trabalho pautou-se na metodologia por meio de um procedimento descri-tivo e exploratório, pela pesquisa qualitativa e análise investigativa teórica de fontes de pesquisa históricas e jurídicas, com amparo no arcabouço normativo, documental, bibliográfico e jurisprudencial. Justificou-se a temática em face à repercussão jurídica do julgamento em controle concentrado exarado, ensejando o efeito backlash na legislação atinente à vaquejada. O desempenho da compe-tência constitucional do STF, dissociado de amparo social, impactou na edição da Emenda Constitucional n.º 96, eivada de inconstitucionalidade material, tratando-se de dissenso o qual já exige e continuará a exigir da comunidade jurídica importantes reflexões.
The vaquejada has a strong cultural base, opposing the state prohibition of practi-ces that subject animals to cruelty. The article seeks to legally analyze the practice of vaquejada and the backlash effect, in view of the relevant legislation and the possibility of its occurrence. The exercise of judiciary power was critically approa-ched when the procedural conduction of Direct Action of Unconstitutionality No. 4,983, absent from social legitimation, resulting in the effect backlash. The present study also makes considerations to the principiological weighting carried out by the Brazilian Federal Supreme Court (STF) in the collision between collective fun-damental rights using Robert Alexy’s theory, known as sopesamento or balancing of principles. The study was based on the methodology through a descriptive and exploratory procedure, through qualitative research and theoretical investigative analysis of historical and legal research sources, supported by the normative, documentary, bibliographic and jurisprudential framework. The thematic was justified in view of the legal repercussion of the judgment in concentrated control, giving rise to the backlash effect in the legislation that deals with vaquejada. The performance of the constitutional jurisdiction of the Supreme Court (STF), without social protection, had an impacted on the edition of Constitutional Amendment No. 96, which has material unconstitutionality, which is a dissent which already requires and will continue the important legal reflections on the legal community.Keywords: Backlash.
