O evidente progresso na evolução da sociedade em várias áreas do conhecimento, incluindo o Direito, ainda não eliminou a visão equivocada de que a função da mulher é satisfazer e despertar o desejo sexual do homem. O presente artigo, intitulado “Violência obstétrica resulta em estupro de vulnerável: violência de gênero reproduzida no tempo presente”, tem como objetivo destacar e discutir casos em que as mulheres são vítimas de violência obstétrica. Assim, surgem os seguintes questionamentos: o estupro de vulnerável existe? Tem relação com a violência obstétrica? A pesquisa bibliográfica é de natureza social e jurídica, qualitativa, com consulta a julgados e artigos científicos. Os objetivos são: a) discorrer sobre a violência obstétrica, um problema histórico que persiste culturalmente na sociedade; b) apresentar a violência obstétrica e o descumprimento da Lei do Acompanhamento 11.108/2005; c) expor o crime de estupro de vulnerável praticado contra parturientes, com análise da legislação e jurisprudência. Os resultados da pesquisa mostraram que, diante da controvérsia doutrinária, recorre-se à jurisprudência do Superior Tribunal de Justiça (STJ). Portanto, destaca-se a necessidade de acompanhante durante a internação de mulheres prestes a dar à luz.

Progress is evident in spite of the evolution that society has been experiencing in several areas of knowledge, including Law, even so, women still suffer from the stigma that their function is to satisfy and awaken sexual desire in men. The article entitled “Abuse, recurrent and embarrassing reality: obstetric violence results in rape with a vulnerable legal legislative and jurisprudential approach”. The objective is to point out and discuss cases in which the woman is a victim and suffers from obstetric violence. Thus, the question arises: Does Rape of Vulnerable exist? Is it related to obstetric violence? The bibliographical research is of a social and legal nature, qualitative, in which there was consultation of judgments and scientific articles. The aim is to: a) discuss Obstetric Violence: a historical problem that is culturally present in society reappears; b) present the Obstetric Violence and Noncompliance with the Monitoring Law 11.108/2005; c) exposing the Crime of Rape of Vulnerable committed against Parturient: legislation and jurisprudence. The results of the research showed that when it comes to doctrinal controversy, it resorts to the jurisprudence of the STJ. Therefore, it envisions the need for a Companion at the time of hospitalization of the woman about to give birth.
