Resumo: O presente estudo visa analisar a importância da efetivação dos direitos fundamentais durante toda persecução penal, inclusive na fase investigatória. Como principal meio de investigação criminal, o inquérito policial, presidido pelo Delegado de Polícia, deve ser abordado à luz dos valores constitucionais como o devido processo legal (administrativo) e, dentro do possível à sua eficácia, os consequentes desdobramentos do contraditório e da ampla defesa. Assim, verifica-se a importância da análise da Lei 13.245/2016 que alterou o Estatuto da OAB garantindo maior participação do advogado no inquérito policial. Não obstante a timidez do legislador no desenvolvimento do tema, tem-se a atenção para uma investigação criminal que, sem perder o caráter inquisitivo e sigiloso, esteja em consonância com a aplicação de direitos ligados à dignidade da pessoa humana, desde que não atropele a legítima eficácia da investigação.

Abstract: This study aims to analyze the importance of enforcement of fundamental rights throughout criminal prosecution, including the investigation stage. As the primary means of criminal investigation, the police inquiry, chaired by the Chief of Police, should be addressed in the light of constitutional values such as due process (administrative) and, as far as possible to its effectiveness, the resulting consequences of the contradictory and wide defense. Thus, there is the importance of analysis of Law no. 13.245/16 which amended the Statute of OAB ensuring greater participation of the lawyer in the police investigation. Despite the legislator's timidity in the theme of development, there is attention to a criminal investigation, without losing the inquisitive and secrecy, is in line with the application of rights linked to human dignity, since it does not run over the legitimate effectiveness of research.
